1. Agreement & Scope of Work
By requesting an estimate, booking services, or engaging Next Gen Landscaping & Yard Care ("Next Gen", "Company", "we", "us"), the client ("Property Owner", "Customer", "you") agrees to these Terms of Service. Next Gen provides residential and light commercial landscaping, LA County fire hazard weed abatement, tumbleweed cleanup, artificial turf installation, desert xeriscaping, tree trimming, and smart irrigation repair across the Antelope Valley region of California.
2. Free Estimates & Quote Validity
All preliminary quotes provided via online form, telephone, or aerial satellite review are based on client-provided specifications. Firm written estimates are valid for thirty (30) days from issuance. On-site inspection may adjust pricing if unforeseen property hazards, hidden debris piles, steep incline changes, or excessive caliche hardpan conditions are discovered.
3. Residential Equipment Guarantee (Zero Tractor Damage)
Next Gen strictly operates commercial walk-behind mowers, heavy-duty string trimmers, professional hand blades, blowers, and dump trailers. We do not drive heavy farm tractors or bulldozers through residential gates. This policy prevents cracking of residential concrete driveways, crushing of shallow PVC irrigation lines, and pulverization of topsoil into fugitive dust.
4. Property Access & Pet Safety
The Customer agrees to provide unobstructed access to the work area during scheduled service hours (gates unlocked, code provided). For crew safety and pet welfare, all domestic animals must be secured indoors or off-site during equipment operation. Next Gen is not liable for pets escaping through opened service gates.
5. Fire Department Weed Abatement Notice Compliance
When performing weed abatement pursuant to an LA County Fire Department or Kern County Fire Department notice, Next Gen clears combustible ground vegetation to statutory standards (maximum 3-inch stubble height, 30-to-100 foot structure defensible space buffer, 10-foot roadway setback). While our clearing is performed to code specifications, final legal clearance approval remains at the discretion of the municipal fire inspector having jurisdiction.
6. Weather & High Desert Wind Delay Policy
Next Gen reserves the right to postpone field work during extreme weather occurrences, including sustained High Desert winds exceeding 40 mph, active lightning storms, or severe flash flood alerts. Rescheduling is prioritized to ensure rapid completion once safe working conditions return.
7. Subterranean Utilities & Pre-Existing Conditions
Customers must advise Next Gen of any shallow, non-code underground wiring, private irrigation manifolds, or septic tank lids. DigAlert (811) is contacted prior to deep excavation projects (such as xeriscape trenches or synthetic turf base preparation).
8. Payment & Cancellation
Payment is due upon completion and inspection of standard cleanups and weed abatements. Larger installation projects (synthetic turf, custom rockscaping) may require a deposit pursuant to California Business and Professions Code provisions. Service appointments may be cancelled or rescheduled without penalty with at least twenty-four (24) hours notice.
9. California Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or dispute arising hereunder shall be subject to the exclusive jurisdiction of the state courts situated in Los Angeles County, California.
